NMC Withdraws 2023 Medical Education Standards Amid Fierce Backlash Over Accountability

New Delhi: In a move that has sent shockwaves through India’s healthcare and academic sectors, the National Medical Commission (NMC) has officially withdrawn the Maintenance of Standards of Medical Education Regulations 2023 (MSMER-2023).

Effective from October 17, 2026 (following a notification published in the Gazette on October 14), the abrupt repeal has ignited a raging debate among medical activists, experts, and institutional authorities over patient safety, transparency, and regulatory oversight.

🔍 What Triggered the Withdrawal?

According to a senior NMC official, the decision came after a thorough review by the Commission’s legal team. The objective? To streamline regulatory powers, eliminate duplication, and remove overlapping procedures across the Commission’s four autonomous boards (which manage undergraduate/postgraduate standards, college assessments/ratings, and medical ethics).

The NMC maintains that its core inspection and verification powers remain intact under the overarching National Medical Commission Act, 2019, and that colleges will continue submitting Annual Disclosure Reports (ADRs).

Furthermore, the NMC clarified that the withdrawal is not retrospective: past actions and violations under MSMER-2023 will still be handled by the regulations where applicable.

⚡ Why Are Experts and Activists Sounding the Alarm?

Despite the NMC’s reassurances, medical advocacy groups and health experts argue that repealing MSMER-2023 strips away vital deterrents, leaving critical enforcement gaps. Key concerns include:

  • Disappearance of Heavy Penalties: Critics point out that the withdrawal removes specific, hard-hitting penalties outlined in MSMER-2023, such as institutional fines of up to ₹1 crore for specific violations, and personal fines of up to ₹25 lakh for faculty, Heads of Department (HoDs), and Deans submitting false records.
  • Dilution of Individual Accountability: Dr. Babu K.V., an ophthalmologist and medical activist, highlighted that deleting clauses like 8(2)c—which penalizes individuals for submitting false declarations or patient records—removes direct punitive measures against wrongdoers, diluting overall oversight.
  • Uncertainty Over Institutional Scrutiny: Consumer rights activist Bejon Kumar Misra (founder-director of PSAIIF) warned that withdrawing a detailed regulatory framework without clear equivalent safeguards creates ambiguity on how institutional deficiencies and fake disclosures will be handled.
  • Putting Patients at Risk: “Medical colleges cannot be judged merely by their buildings, equipment, or number of approved seats,” Prof. Misra stressed. “The real measure of medical education is the competence of graduating doctors, the availability of qualified faculty, and their ability to deliver safe and ethical patient care.”

📈 The Stakes Are Higher Than Ever

With India housing a staggering 846 medical colleges, 1,39,864 MBBS seats, and 86,360 postgraduate medical seats (as of August 2026 data), the rapid expansion of medical education demands foolproof governance.

As the dust settles on this controversial regulatory rollback, the central question remains: Can the remaining framework hold defaulting medical institutions accountable, or will patient safety fall through the cracks?
